Severe Perineal Tear and Pelvic Floor Injury

  • Outcome: Settlement [$260,000 incl. costs]
  • Court: County Court of Victoria
  • Defendant: Regional Victorian Public Hospital

The plaintiff was a young mother who suffered significant and life-changing injuries following the birth of her daughter in November 2016.

During labour, complications developed in the second stage of delivery and an instrumental vaginal birth was performed. Following the birth, the plaintiff began experiencing severe vaginal pain, infection and ongoing complications in the episiotomy area. Medical investigations later confirmed that she had sustained a perineal tear and pelvic floor injury, resulting in long-term physical and psychological consequences.

Serious and Lasting Consequences

The injuries caused a range of debilitating symptoms. The plaintiff developed recurrent infections, pelvic floor dysfunction and vaginal prolapse, which resulted in constant discomfort and restricted her ability to carry out normal physical activities.

She also suffered chronic pain, constipation and dyspareunia (pain during sexual intercourse), significantly affecting her personal life and relationships. The trauma of the birth and its consequences led to ongoing anxiety and depression, requiring psychological treatment.

Ultimately, the severity of her prolapse required reconstructive pelvic surgery in an attempt to repair the damage caused during childbirth.

Impact on Her Life

Beyond the physical pain, the injuries profoundly affected the plaintiff’s quality of life. She experienced embarrassment and distress associated with her prolapse and the long-term complications of her injuries. The impact extended to her personal relationships and family planning, as she was advised that future pregnancies could worsen her condition.
