• WHAT WE DO

Whatever happened during your birth – there is somewhere to start.

Birth Injury Lawyers provides specialist legal representation across four areas of birth-related medical negligence. Every situation is different. Every claim is personal. The first step is simply a conversation.

01 / 04

Maternal Birth Injury

Severe tearing, haemorrhage, pelvic floor injury, failure to obtain your consent — injuries suffered by mothers during childbirth are among the most under-recognised in Australian law. If you were harmed, you may have rights you haven’t yet explored.

Infant Brain Injury
& Cerebral Palsy

When oxygen deprivation during labour causes lasting harm to your baby, the consequences are lifelong. If failures in fetal monitoring or emergency care contributed to your child’s brain injury, your family may have a claim.

Psychological
Injury to Families

Birth trauma does not only happen to the person giving birth. Partners and family members who witness a traumatic delivery can suffer serious and lasting psychological harm — and in many cases, they have legal rights too.

High Risk Pregnancy
Mismanagement

A high-risk pregnancy demands a higher standard of care. When risk factors are overlooked, monitoring is inadequate, or critical decisions are delayed, the consequences for mother and baby can be serious and irreversible.

Time limits apply — but the date
may be
later than you think.

In most Australian jurisdictions, a birth injury claim must be commenced within 3 years of the date the claim becomes discoverable — which is not necessarily the date of birth. For many women, that clock starts when they first understood their injury may have been preventable. If you are unsure, the most important thing you can do is ask.

If something went wrong during your birth, you deserve to know your rights.

A conversation costs nothing. There is no obligation and no pressure
— just honest, expert advice.
